1. Introduction

These terms and conditions govern the use of the Globe Chaser app, an application for outdoor experiences, developed and published by the U.S. company Bright & Epic USA Inc., located in the U.S..

By downloading and using Globe Chaser, as well as through any additional agreements (e.g., with team-building agencies and other B2B partners) and its software extensions, you agree to these terms.

2. User Eligibility

The app is suitable for families with children aged 4+, adults, and teams.
Users under the age of 18 should have parental or guardian consent to use the app.

3. Account Registration

Users must register an account to participate in or create adventures.
Account information must be accurate and kept up-to-date.

4. Free and Paid Services

Downloading and joining adventures is free of charge.
Creating adventures or accessing premium features requires a subscription or in-app purchases to the *Premium Edition* on the App Store, or the purchase of coins to unlock additional in-app features.
Detailed services and fees for plans are available on the App Store and Google Play Store.

5. In-App Purchases

Users can purchase upgrades such as extra teams, extra checkpoints, or other features.
Prices for these upgrades are as listed in the app.
Users may also purchase coins to unlock additional in-app features.
In-app purchases are charged on a consumption basis.

6. Subscription Terms

Subscriptions for the *Premium Edition* are billed monthly or annually.
Automatic renewal unless canceled 24 hours before the end of the current period.
No refunds for partial months or years.

7. User Responsibilities and Liability

Users are solely responsible for their safety and the safety of their group while using the Globe Chaser app.
It is the user’s responsibility to ensure that all activities are conducted in a safe and lawful manner.
Users must assess the risks associated with each adventure and act accordingly.
Globe Chaser is not responsible for supervising or ensuring the safety of users during their participation in activities.
Users must comply with all local laws and regulations and respect both public and private property during their adventures.
Users are fully liable for any accidents, injuries, or damages that occur as a result of their participation in activities facilitated by the Globe Chaser app.
Globe Chaser shall not be held liable for any harm, injury, or loss incurred as a result of or in connection with the use of the app, except to the extent such liability cannot be excluded by law.

8. Indemnification

Users agree to indemnify and hold harmless Globe Chaser, its affiliates, officers, agents, and employees from any claim, demand, loss, liability, or expense arising out of or in relation to the use of the app, including but not limited to: violation of these terms, violation of any rights of another, or violation of any applicable laws or regulations.

9. Intellectual Property

Globe Chaser and its content are protected by intellectual property laws.

10. Data Protection

The app collects and processes personal data as described in our Privacy Policy.

11. Termination

Globe Chaser reserves the right to terminate or suspend accounts for breach of these terms.

12. Limitation of Liability

Globe Chaser is not liable for any indirect, incidental, or consequential damages.

13. Changes to Terms and Conditions

Globe Chaser may update these terms and will notify users of significant changes.

14. Governing Law

These terms are governed by the State of Florida.

15. Early Access, Beta, and Demo Versions

The Globe Chaser app may offer Early Access, Beta, and Demo versions of the software and/or extensions (such as the *Team Builders Edition*). These versions are provided for testing and feedback purposes and may not be fully developed or error-free. Users who choose to purchase subscriptions for Early Access, Beta, or Demo versions acknowledge that these versions are not final products and may contain bugs or incomplete features.

At the moment, there is a special *Team Builders Edition* available in the beta stage, which includes a dashboard along with the use of the app. This dashboard allows team-building agencies to manage their adventures and teams from a computer. The dashboard can be accessed by logging in with credentials provided upon subscription.

By purchasing a subscription for these versions, the user agrees to accept any potential risks associated with using unfinished software. In recognition of this, subscription fees for Early Access, Beta, or Demo versions may be lower than for fully released versions. Users understand that this discount reflects the potential for technical issues and incomplete functionality.
Errors caused by network connections, fluctuations, or similar technical disruptions may occur at any time, and therefore, we cannot assume any liability for resulting outages.

Furthermore, Globe Chaser is not liable for any injuries, accidents, or damages that may occur through the improper or unsafe use of the app, failure to observe one’s local perimeter, or neglecting to comply with relevant local laws and safety guidelines while using the app. Users are solely responsible for ensuring that all activities are conducted safely and in accordance with their local regulations.

Additionally, Globe Chaser is not responsible for the improper use of the dashboard system, and any issues arising from such use, including but not limited to software errors, are outside of Globe Chaser’s liability. Users acknowledge that software errors may occur, and it is the user’s responsibility to use the system appropriately and report any issues promptly.

Globe Chaser and its company, Bright & Epic USA Inc., are not responsible for any content, code, or any other imprecision. Globe Chaser does not provide warranties or guarantees.

In no event shall Globe Chaser be liable for any special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract, negligence, or other tort, arising out of or in connection with the use of the Service or the contents of the Service. The Company reserves the right to make additions, deletions, or modifications to the contents on the Service at any time without prior notice.

The Globe Chaser Service and its contents are provided “as is” and “as available” without any warranty or representations of any kind, whether express or implied. Globe Chaser is a distributor and not a publisher of the content supplied by third parties; as such, Globe Chaser exercises no editorial control over such content and makes no warranty or representation as to the accuracy, reliability, or currency of any information, content, service, or merchandise provided through or accessible via the Globe Chaser Service. Without limiting the foregoing, Globe Chaser specifically disclaims all warranties and representations in any content transmitted on or in connection with the Globe Chaser Service or on sites that may appear as links on the Globe Chaser Service, or in the products provided as a part of, or otherwise in connection with, the Globe Chaser Service, including without limitation any warranties of merchantability, fitness for a particular purpose or non-infringement of third-party rights. No oral advice or written information given by Globe Chaser or any of its affiliates, employees, officers, directors, agents, or the like will create a warranty. Price and availability information is subject to change without notice. Without limiting the foregoing, Globe Chaser does not warrant that the Globe Chaser Service will be uninterrupted, uncorrupted, timely, or error-free.
